1. INTRODUCTION
The Rules & Regulations below set out the terms and conditions for online booking and hire of premises at www.apartamenty24.pl.
An online booking made at www.apartamenty24.pl shall constitute complete acceptance of the Rules & Regulations below and, at the same time, conclusion of the Premises Hire Agreement.
2. BOOKING
Advance bookings shall be made by completing the Booking Form provided at apartamenty24.pl website. The amount of advance payment shall be specified by the Owner of premises under consideration. Advance payment shall be made to the Hirer by bank transfer or by credit card. Once advance payment has been made, a booking shall be considered as completed.
a) Payment by bank transfer
In case of payment by bank transfer, the person booking premises shall receive an e-mail notification with booking confirmation. The e-mail notification shall contain the data necessary for making the payment. The person booking premises may make an advance payment or pay the full amount due. As direct bank transfers may take over 3 days to reach the payee, especially when sent by Polish postal services, we recommend contacting the Hirer by e-mail. The Hirer may demand submission of confirmation of payment by fax, or submission of a scanned copy of confirmation of payment by e-mail. If the 3-day deadline is exceeded, the booking shall be cancelled automatically, except for bookings confirmed by phone or e-mail by the Hirer.
b) Payment by credit card
In case of payment by credit card, advance payment must be made within 20 minutes from booking by clicking the relevant link. Failure to complete advance credit card payment within 20 minutes shall result in definite cancellation of the booking.
Upon receipt of advance payment, the Customer shall be sent an e-mail confirmation with a voucher containing the following data:
- Confirmation of acceptance of booking,
- Confirmation of payment,
- Booking code,
- Contact data to person holding keys to premises,
- Data necessary for execution of hire.
The remaining amount must be paid not later than on the first day of stay to the person responsible for transferring the keys.
Advance payment shall be non-refundable.
3. SCOPE OF PREMISES HIRE AGREEMENT
The Premises Hire Agreement entered into by and between the premises Owner and the Customer shall cover solely hire of premises and utility fees - such as electricity, gas, and media, as well as cleaning after completion of the period of hire. Any other costs, in particular costs of transportation, board, etc. shall be covered by the Customer. Calculation of prices must be made on the basis of the Price List provided at www.apartamenty24.pl website for particular premises. The Owner shall not demand any additional payments over those specified on the website of the premises, except for stays with pets (see art. 8 below).
4. ARRIVAL, TRANSFER OF KEYS, DEPARTURE
Check-in time on the first day of hire shall be 02:00 pm and must be confirmed by contacting the person responsible for transferring the keys by phone or by e-mail. By way of exception, a different check-in time may be agreed upon also by contacting the person responsible for transferring the keys by phone or e-mail. Check-in time may be changed at the latest 24 hours before the standard commencement of the hire period. The hire shall end at 12:00 pm on the day of departure.
In the event of occurrence of an act of Force Majeure or any other occurrences resulting in a delay of arrival, the Customer must immediately notify the person responsible for transferring the keys by phone. The amount remaining to be paid, irrespective of the actual date of arrival or departure, shall be as stated on the previously received voucher.
5. CUSTOMER'S OBLIGATIONS
The Customer shall be under the obligation to:
- Submit an e-mail notification of a change of number of occupants of the hired premises. The number of occupants of the premises binding for both Parties shall be the number specified in the booking and confirmed with the e-mail containing a voucher.
- Take due care to comply with good neighbourhood principles.
- Maintain the hired premises in good condition.
- Wash the dishes and kitchen appliances before departure.
- Immediately notify the person responsible for transferring the keys of any damage occurring during their stay in the hired premises. Costs of removal of damage shall be covered by the Customer.
6. CHANGES IN BOOKING
a) Change of date of stay
Up to 14 days prior to arrival and after advance payment is made, the date of stay may be changed. Only the date of arrival may be changed. Duration of stay, as well as pre-selected premises shall not be subject to change. Changes of booking shall require activation of the booking cancellation procedure by clicking the relevant link provided in the e-mail containing booking confirmation. The next step shall be making a new booking and submitting the number of previous booking for which advance payment was made in NOTES field. If prices of hire of premises for new dates are higher, additional payment shall be required upon transfer of the keys to the hired premises.
b) Extension of stay
Duration of stay in the hired premises may be extended. In order to extend the duration of stay, the Customer must submit a due notification by clicking the relevant link provided in the e-mail with booking confirmation (EXTENSION OF STAY OR CHANGE OF BOOKING).
c) Change of number of occupants
The number of occupants specified in the voucher may be changed. In order to change the number of occupants, the Customer must submit a due notification by e-mail or add a note by clicking the relevant link provided in the e-mail with booking confirmation.
7. FREE OFF CHARGE STAY FOR A CHILD
If you plan a stay with a child less than 5 years of age who does not require separate bed sheets, please indicate your intention when making a booking by submitting the child's age in NOTES field of the Booking Form. No fees shall be charged for a stay of such a child in the premises. Older children (age 6 and older) shall pay the full price.
8. CHARGES FOR PETS
A stay with a dog or a cat shall be subject to the additional charge of PLN 10.00 per day. The only exception shall be those premises for which stays with pets have been marked as unavailable. At the same time, the Customer shall be held fully liable for any damages caused by pets. The Owner of the damaged property shall decide about the appropriate remedy, and the Customer shall be under the obligation to meet such a liability.
9. CHANGE OF PREMISES
In the event of occurrence of extraordinary and unpredictable circumstances, the Owner shall have the right to change the booked premises without decreasing the standard. The Owner shall have the right, in the event of occurrence of an act of Force Majeure, to cancel the Premises Hire Agreement. This shall also apply to cases when Customer's personal safety or safety of Customer's property cannot be guaranteed, due to reasons outside the Owner's control. The amounts paid by the Customer shall be subject to immediate refund, with deduction of amounts due for any services already rendered.
10. GOVERNING LAW
The governing law for disputes between the Owner and the Customer shall be the Polish law. All disputes shall be solved by the court with jurisdiction over the Owner's registered office.
